Paternity and the Rights of Parents
If a paternity test proves that a man is the father of a child, he may be ordered to pay child support as part of a paternity suit. However, a biological father may also wish to have fathers’ rights, including rights to child custody and visitation, established and to legitimate his relationship with the child.
The current marital status of the parents has no bearing on paternity or legitimation. In addition, having the father’s name on the birth certificate does not necessarily entitle the father to any legal rights, including visitation. Therefore, it is important to have legal counsel on your side to ensure that your rights remain protected and to help guide you through the process of establishing those rights.
